Initial Custody Determinations
California family court does not generally favor mothers over fathers in custody orders. Instead, the court has discretion to decide what is in the best interests of the children. This usually includes working with the family, who will have gone through mediation and agreed on a parenting plan. If the parents cannot agree on a parenting plan, the court will make the custody decision.
The types of child custody arrangements in California include:
- Physical custody — who the children live with
- Legal custody — who makes decisions for the children's health care and education
- Sole custody — one parent makes the decisions for the child's care and well-being
- Joint custody — both parents share the decision making and care
Visitation, also called timesharing, grants the noncustodial parent time with the children. It may be specified in the parenting plan or it may be decided by the court.
Modifying Custody Orders
You may request a change to your custody agreement. However, both parents must agree to the change or there will be a hearing with a judge to prove why the change benefits the child. The court will generally rule in the best interest of child. Reasons modifications may be granted include relocation, changing needs of a child, a change in financial circumstances or the fitness of a parent.
