Spousal Support in California
Spousal support can be granted for a number of reasons. In general, people qualify for spousal support based on their age, health, capacity to earn, how much their spouse earns and the standard of living during the marriage, though there are some exceptions and special considerations. In general, marital fault is not a consideration in the granting of spousal support. However, domestic violence victims are often granted support.
The length of the marriage may also be a factor in determining spousal support. For marriages of less than 10 years, spousal support is generally awarded for half the length of marriage. For marriages of more than 10 years, support may be granted indefinitely.
Spousal support in California is usually awarded in the following ways:
- Temporary — Payments are made while the couple is separated but the divorce is not yet final.
- Permanent — Payments continue indefinitely unless the recipient marries or lives permanently with a supportive partner.
In cases of high-asset divorce, it is important to balance the reasonable needs of the party receiving support with the income of the payer and the standard of living acquired during the marriage.
